Terms of Service

By creating a Cashundo account or using any part of the Cashundo service ("Service"), you ("User", "Data Principal") confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookie Policy. If you do not agree to these Terms, you must not use the Service. These Terms constitute a binding legal agreement between you and Cashundo (operated by Cashundo Team, the "Operator", "we", "us"). The Service is governed by the laws of India.

You must be at least 18 years of age to use the Service independently. If you are between 13 and 17 years of age, you may use the Service only with the verifiable consent of a parent or legal guardian, who shall be responsible for your use and compliance with these Terms. By using the Service, you represent and warrant that: • You are at least 18 years old, OR you have obtained verifiable parental/guardian consent. • You have the legal capacity to enter into a binding agreement under Indian law. • You are not prohibited from using the Service under any applicable law or regulation. In accordance with Section 9 of the Digital Personal Data Protection Act, 2023 ("DPDPA"), we do not knowingly collect personal data of children under 13 years of age. If we become aware of such collection, we will delete the data immediately.

To use the Service, you must register an account with a valid email address and a strong password (meeting the complexity requirements displayed during signup). You are responsible for: • Maintaining the confidentiality of your account credentials. • All activity that occurs under your account. • Immediately notifying us at cashundo.in@gmail.com if you suspect any unauthorised access to your account. • Keeping your Telegram link code confidential. If you choose to connect Telegram, a one-time link code is generated in Settings → Telegram. This code expires after use and is rate-limited to 5 attempts per 15-minute window. Do not share this code with anyone. We are not liable for any loss or damage arising from your failure to maintain the security of your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.

Cashundo is a personal finance management application that allows you to: • Track income, expenses, and account balances. • Manage budgets, categories, and financial goals. • Track shared expenses ("Splits") with other users. • Monitor debt obligations and repayment schedules. • Track investment portfolios using publicly available market data. • Manage financial reminders and calendar events. • Operate in Family Mode to share selected financial data with household members. • Connect a Telegram account to log transactions and manage reminders via the Telegram Bot and Mini App at telegram.cashundo.in (optional feature). The Service is provided on an "as-is" and "as-available" basis. We do not provide financial advice, investment recommendations, tax advice, or legal advice. The Service is a tool to organise your own financial data; you are solely responsible for all financial decisions you make.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not: • Use the Service for any unlawful purpose or in violation of any applicable Indian or international law or regulation. • Attempt to gain unauthorised access to any part of the Service, other users' accounts, or the underlying infrastructure. • Introduce malicious code, viruses, or any software that may damage or interfere with the Service. • Use automated scripts, bots, or scrapers to access the Service. • Misrepresent your identity or impersonate any person or entity. • Use the Service to process or store data on behalf of others (the Service is for personal, non-commercial use only). • Reverse engineer, decompile, or disassemble any part of the Service. We reserve the right to terminate access for any violation of these restrictions, without prior notice.

You retain full ownership of all personal financial data you enter into Cashundo. We do not claim any intellectual property rights over your data. By using the Service, you provide free, specific, informed, unconditional, and unambiguous consent (as required under Section 6 of the DPDPA) to the processing of your personal data as described in our Privacy Policy, solely for the purpose of operating and improving the Service. You may withdraw consent at any time by deleting your account. Upon deletion, all your data is permanently erased within 24 hours. Withdrawal does not affect the lawfulness of processing that occurred prior to withdrawal. Your rights as a Data Principal under Chapter III of the DPDPA - including the right to access, correct, erase, and seek grievance redressal - are described in our Privacy Policy.

The Service uses the following third-party providers to operate: • Supabase Inc. - database, authentication, and storage (Mumbai region). • Vercel Inc. - web application hosting. • Google LLC - optional OAuth login. • Telegram Messenger Inc. - optional bot and Mini App integration. When you connect your Telegram account using Settings → Telegram, bot commands and Mini App actions at telegram.cashundo.in are processed through Telegram's infrastructure. By connecting Telegram, you additionally agree to Telegram's Terms of Service (https://telegram.org/tos) and Privacy Policy (https://telegram.org/privacy). You can disconnect at any time from Settings → Telegram or by sending /disconnect to the bot. Live currency exchange rates and stock market prices are fetched from public third-party APIs on a server-side basis. These rates and prices are provided for informational purposes only. We make no representations about their accuracy, completeness, or fitness for any particular purpose. Do not rely on this data for investment or financial decisions. Your financial data is never shared with these data providers. Connecting Telegram does not transmit your financial records to Telegram.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that: • The Service will be uninterrupted, error-free, or secure at all times. • Any market data, exchange rates, or financial calculations provided are accurate or suitable for decision-making. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. Our total aggregate liability to you for any claim arising out of or relating to the Service shall not exceed INR 1,000 (Indian Rupees One Thousand). Nothing in these Terms excludes or limits liability for fraud, gross negligence, or any other liability that cannot be excluded by law.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may update these Terms from time to time. When we make material changes, we will notify you via an in-app banner and/or email before the changes take effect. The "Last Updated" date at the top of this page will reflect the most recent revision. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.

You may delete your account at any time from Settings → Delete Account or by contacting us at cashundo.in@gmail.com. Upon deletion, all your personal data is permanently erased within 24 hours. We may suspend or terminate your account immediately, without prior notice or liability, if: • You breach these Terms. • We are required to do so by applicable law or a lawful order. • Continued operation poses a security risk to other users. Upon termination, your right to use the Service ceases immediately. Termination does not affect any accrued rights or obligations.

If your complaint is not resolved to your satisfaction, you may escalate to the Data Protection Board of India (once operational) or pursue other remedies available under Indian law. These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of India. Before initiating any legal proceedings, you agree to first attempt to resolve the dispute by contacting us at cashundo.in@gmail.com. We will make good-faith efforts to resolve any dispute amicably within 30 days of notification.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms, without affecting the enforceability of the remaining provisions. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and the Operator with respect to the Service, and supersede all prior agreements, understandings, and representations.
